Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Private Practice Course website and the online course, videos, podcast feeds, notes, downloads and related materials made available through it (together, the "Service"). The Service is operated by Rheum2Learn Pty Ltd (ABN 16 688 507 619), trading as The Private Practice Course ("we", "us", "our").
Please read these Terms carefully before subscribing or using the Service. By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
1. About the course — educational content only
The Service provides general educational and informational content about setting up, running and growing a private medical practice in Australia. It is designed for medical practitioners, advanced trainees and early-career physicians.
The content is general in nature and does not take into account your individual circumstances. It is not, and must not be relied on as, financial, accounting, taxation, legal, medical or other professional advice. You should obtain your own independent professional advice before making decisions about your practice, finances or compliance obligations.
Using the Service does not create any professional, advisory, doctor–patient, partnership, employment or agency relationship between you and us or the instructor. References to professional bodies, CPD eligibility (including RACP CPD), regulators or third-party tools are for information only and are not endorsements, and CPD eligibility ultimately depends on your own assessment against your college's requirements.
We make no guarantee about the results you will achieve. Outcomes depend on your own circumstances, decisions, effort and factors outside our control. We do not warrant or represent that you will earn any particular income or build a practice of any particular size.
2. Eligibility and accounts
You must be at least 18 years old and able to form a legally binding contract to use the Service. You agree to provide accurate, current and complete information when registering and to keep it up to date.
Your account is personal to you. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must notify us promptly at narain@kamalaraj.com if you become aware of any unauthorised use of your account.
3. Subscription, fees, GST and auto-renewal
Access to the Service is sold as a recurring annual subscription. The current price is AUD $497 plus GST per year. Prices are displayed in Australian dollars and are exclusive of GST, which is added at the applicable rate (currently 10%). We are registered for GST and will issue a tax invoice for your subscription.
Your subscription renews automatically each year unless cancelled before the renewal date. By subscribing, you authorise us and our payment provider to charge your nominated payment method the then-current subscription fee at each renewal. Before each annual renewal we will send a reminder to your registered email address, stating the renewal date and the amount payable, so you have the opportunity to cancel beforehand if you do not wish to continue.
Payments are processed by our third-party payment provider (Stripe). We do not collect or store your full card details. You are responsible for providing a valid payment method and for any fees your bank or card issuer may charge.
We may change subscription prices from time to time. We will give you reasonable advance notice of any price change before it applies to your next renewal, so you can cancel before the new price takes effect if you do not wish to continue.
4. Cancellation
You may cancel your subscription at any time through your account settings or by emailing narain@kamalaraj.com. Cancellation stops future renewals. Unless a refund is required by law (see section 5), cancellation does not refund the current subscription period, and you will retain access until the end of the period you have already paid for.
5. Refunds and your Australian Consumer Law rights
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a remedy, and you are entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem fixed within a reasonable time and, if this is not done, to a refund.
Because the Service is digital content delivered immediately on subscription, we do not offer change-of-mind refunds once you have access. This does not affect your rights under the Australian Consumer Law described above.
If you believe the Service has not been delivered with due care and skill, is not as described, or is not reasonably fit for its stated purpose, contact us at narain@kamalaraj.com and we will work with you to provide the remedy required by law.
6. Licence and acceptable use
While your subscription is active and you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and view the content for your own personal, professional development. You must not:
- share, sell, lend or transfer your account or login details, or allow anyone else to access the Service using your account;
- copy, download (except where a download is expressly provided), record, reproduce, republish, distribute, broadcast or publicly display any content, except as expressly permitted;
- use the content for any commercial purpose, including reselling, sub-licensing or incorporating it into your own paid materials, without our written permission;
- circumvent, disable or interfere with any security, access-control or streaming-protection features; or
- use the Service in any way that is unlawful, infringes the rights of others, or could damage, disable or impair the Service.
We may suspend or terminate access where we reasonably believe these Terms have been breached.
7. Intellectual property
All content made available through the Service — including videos, audio, text, notes, graphics, course structure, look and feel, trade marks and logos — is owned by us or our licensors and is protected by intellectual property laws. Except for the limited licence in section 6, no rights are granted to you.
If you send us feedback, suggestions or ideas about the Service, you agree we may use them without restriction or obligation to you, while you retain ownership of any pre-existing materials you separately own.
If you believe content on the Service infringes your intellectual property rights, please contact us at narain@kamalaraj.com with details of the material, your rights, and the location of the content, and we will investigate.
8. Third-party services
The Service relies on third-party providers (for example, for payments, hosting, video streaming and email). We are not responsible for the performance of third-party services or for problems caused by them, and your use of those services may be subject to their own terms. We will use reasonable efforts to keep the Service available but do not guarantee uninterrupted or error-free access.
9. Disclaimers and limitation of liability
Nothing in this section limits your rights under the Australian Consumer Law or any other law to the extent they cannot be excluded. Subject to those rights:
- the Service and its content are provided “as is” and we do not warrant that they will be uninterrupted, error-free, or free of harmful components;
- to the maximum extent permitted by law, we exclude all implied warranties and are not liable for any indirect, incidental, special or consequential loss, or loss of profits, revenue, goodwill or data, however arising; and
- to the extent we are able to limit (rather than exclude) our liability for a breach of a consumer guarantee, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to the amount you paid us for the subscription in the 12 months before the event giving rise to the liability.
10. Indemnity
You agree to indemnify us and our directors, officers, employees and agents against any claims, liabilities, damages and reasonable legal costs arising out of your breach of these Terms, your misuse of the Service, or your infringement of any law or third-party right, except to the extent caused by our own negligence or breach.
11. Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge our Privacy Policy.
12. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service entirely, we will give reasonable notice and a pro-rata refund of any prepaid period not yet used. On termination, your licence to use the content ends.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by email or a notice on the website) before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia. If any provision is found to be unenforceable, it will be severed and the remaining provisions will continue in force.
